  However, most bankruptcies will reflect on your report for a similar period as a late payment. Here is how long bankruptcy stays on your credit file compared to other negative information:

  Also called a wage earner’s plan, the Chapter 13 bankruptcy is a debt repayment plant that allows persons with regular income to develop a plan to pay some or all of their debts. The debtors propose a repayment plan to make installments for a certain period of time – usually three to five years.

  Once the plan is completed, the remaining unsecured debt is discharged or eliminated. So, how long does it take you to recover from the Chapter 13 bankruptcy?

  Usually, the completed Chapter 13 bankruptcy and the accounts used in the program take around seven years after the date of filling to disappear. The ineligible accounts are also removed from the report soonest possible.

<p class="wp-block-paragraph">   It may not feel like an important thing, but you should save all paperwork from your bankruptcy case. You may be requested to hand in the files in the future, especially when applying for mortgages, personal loans, or other financial products. </p>



<h3 class="wp-block-heading">Save money </h3>



<p class="wp-block-paragraph">
  Once you’re declared bankrupt, the last thing you want is to fall into debt again. Start saving money for emergencies, watch your daily spending, and create a budget to ensure this doesn’t happen.

<p class="wp-block-paragraph">Debt is a real problem, and it is not one made from purely irresponsible people who rack up debt and refuse to pay their bills.</p>



<p class="wp-block-paragraph">Indeed, the United States government, presumable our ideal example of how to manage finances, currently holds billions of dollars in debt to its creditors and often comes to the brink of default when our legislators cannot come to an agreement on whether to extend our debt ceiling and pay our bills.</p>

<p class="wp-block-paragraph">You had the best of intentions, you worked hard for years to pay your bills, and eventually, they got the best of you.</p>



<p class="wp-block-paragraph">The struggle to pay off your debts finally became so overwhelming that you spent more time stressed out, overworked, and exhausted, that you could not contribute happiness and health to yourself, your family, and your lifestyle anymore.</p>



<p class="wp-block-paragraph">Bankruptcy laws were put into place for this very reason: to stop you from spending the rest of your life in a state of chronic stress and ill health trying to “make up for past mistakes.”</p>

<p class="wp-block-paragraph"><strong>Life After Bankruptcy</strong></p>



<p class="wp-block-paragraph">Once you file for bankruptcy, your life should already start to go a bit smoother. The endless stream of credit collectors calling should stop. If they don’t refer them to your lawyer and let them know you are filing for bankruptcy.</p>



<p class="wp-block-paragraph">By law, they are required to stop calling after you let them know.</p>



<p class="wp-block-paragraph">Once your debt is discharged, all of your creditors should be notified, and they should charge off your debt. Your credit report via the credit bureaus should reflect that. If you are unsure if it does, get a copy of your personal credit report to check.</p>



<p class="wp-block-paragraph">If it does not, if your creditors keep calling, or if your credit report does not reflect your bankruptcy and all of your debts charged off, you will need to contact both the creditor and the credit reporting agency.</p>



<p class="wp-block-paragraph">You will likely be asked for a copy of your bankruptcy discharge papers or bankruptcy records as proof of charge off.</p>



<h2 class="wp-block-heading"><strong>How to Get a Hard Copy of Your Bankruptcy Discharge Papers</strong></h2>



<p class="wp-block-paragraph">First, your lawyer should send you a copy after your bankruptcy is discharged, so you could always go through your lawyer’s office. In the event you cannot get a hold of your lawyer, or you did not have a lawyer, you can request your bankruptcy paperwork directly from the US Bankruptcy Court.</p>

<p class="wp-block-paragraph">You can simply Google “email request form for bankruptcy discharge papers in the state of __________” to get your state’s contact form.</p>



<p class="wp-block-paragraph">Be sure to include your full name, the date of your discharge, your case number, your email address, your physical address, and your phone number.</p>



<p class="wp-block-paragraph"><strong>2.&nbsp;&nbsp;&nbsp;&nbsp;Internet</strong></p>



<p class="wp-block-paragraph">You could also go through the internet for your request. This process is much quicker and more streamlined.</p>



<p class="wp-block-paragraph">The bankruptcy discharge internet system is called <a href="https://pacer.uscourts.gov/" rel="noreferrer noopener" target="_blank">PACER</a>.</p>



<p class="wp-block-paragraph">Using the pacer system, you’ll pay a maximum of $3 per document, and you’ll need all the same basic information as above.</p>



<p class="wp-block-paragraph"><strong>3.&nbsp;&nbsp;&nbsp;&nbsp;Visit the Court Clerk Office</strong></p>



<p class="wp-block-paragraph">You can also walk into the county clerk’s office and make your request in person. Go to the&nbsp;same county where your bankruptcy was filed, bring all of your information and expect the&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;same fee as above.</p>



<p class="wp-block-paragraph">To find your county clerk’s office, just Google “___________ County Clerk Office location.”</p>



<p class="wp-block-paragraph"><strong>4.&nbsp;&nbsp;&nbsp;&nbsp;Mail a request to the Clerk’s Office</strong></p>



<p class="wp-block-paragraph">As a last resort, you don’t have email, you don’t have internet access and can’t get it, and you are unable to go to the county Clerk’s Office, you can mail in your request.</p>



<p class="wp-block-paragraph">You will pay a copy fee of $.50 per page, and you may pay an additional search fee if your clerk has to spend time looking for your documents.</p>



<p class="wp-block-paragraph">This is a last resort and should be avoided if at all possible.</p>



<p class="wp-block-paragraph">But, you can indeed correspond via mail. Simply Google that same address as above and request your docs, including all of your information. The clerk will mail you back, eventually, letting you know what further information, and fees, they need to complete your request.</p>



<p class="wp-block-paragraph"><strong>Submit Your Copies</strong></p>



<p class="wp-block-paragraph">Once you have your copies in hand, be sure you get extra copies run off from your home printer or at a local copy supply store. Keep a few copies on hand so you can mail them or scan and email them to anyone who has not reflected your bankruptcy in their records.</p>



<p class="wp-block-paragraph">You will also want to contact the three credit reporting agencies and send them a <strong>bankruptcy discharge copy</strong> to be sure they clean up your report properly.</p>

<h2 class="wp-block-heading">What is a Charge-Off?</h2>



<p class="wp-block-paragraph">A charge-off is a term used to reflect the fact that a lender attempted to collect a debt from a borrower but was unsuccessful. In essence, the borrower failed to repay the debt, and the lender is no longer trying to collect.</p>



<p class="wp-block-paragraph">A charge-off reflects negatively on a borrower’s credit report and can cause their credit score to drop, affecting their success in acquiring future credit. A charge-off can be used with different types of debt, like credit cards, mortgages, auto loans, etc.</p>



<p class="wp-block-paragraph">A lender can only charge off a debt when it reaches a certain level of delinquency, and that varies by the type of debt. For instance, credit card debt can only be charged off after the loan has been delinquent for 180 days; a personal loan can only be charged off after it has been delinquent for 120 days. Debt can also be charged off following death or bankruptcy.</p>



<p class="wp-block-paragraph">After an account is charged off, the lender can sell it or assign it to a debt collection agency. A collection agency can still attempt to collect the debt even though it was charged off by the original lender. Most of the time, the original lender will then report this loss of repayment of the debt on their taxes. </p>



<h2 class="wp-block-heading"><a></a>How Long Does a Charge-Off Stay On Your Credit Report?</h2>



<p class="wp-block-paragraph">A charge-off will stay on your credit report for seven years after the date the account went into delinquent status. Meaning, even though a charge-off may not be reported until six months after the account went delinquent, the first six months prior when it first went delinquent is still counted as part of the seven years. Once a legitimate charge-off is on your credit, it is difficult to get removed (but not impossible).</p>



<h2 class="wp-block-heading"><a></a>How to Remove a Charge-Off On Your Credit Report</h2>



<p class="wp-block-paragraph">Removing charge-offs from a credit report is a very difficult thing to do. Especially if it’s a legitimate charge-off. Negative credit information can remain on a credit report for at least seven years, some longer. However, there may be some things you can attempt to get a charge-off removed.</p>



<h3 class="wp-block-heading"><a></a>Inaccurate Reporting</h3>



<p class="wp-block-paragraph">If you feel the charge-off on your report is inaccurate, you can dispute the report with the credit bureau that’s reporting the inaccurate information. The credit bureau will investigate your claim and correct it if it’s proven inaccurate. If the inaccurate information or reason you list on your dispute cannot be validated, the credit bureau will delete the charge-off from your credit profile.</p>



<h3 class="wp-block-heading"><a></a>Pay for Delete</h3>



<p class="wp-block-paragraph">If the charge-off is accurate, you could try negotiating with the lender or debt collector to update or remove the charge-off from your credit report. That is called pay for delete, and as the name implies, you’re asking for the information to be removed from your report, in exchange for paying towards the charged off amount.</p>



<p class="wp-block-paragraph">That is a legal request on the borrower’s part. However, though legal, the request doesn’t have to be honored. If the lender or debt collector does agree to honor the request, the borrower will likely have to pay all of the debt, or a good portion of it. The lender may agree to a settlement, which is less than the full amount owed.</p>



<p class="wp-block-paragraph">Make sure any arrangements agreed upon with the lender or debt collector are stated in writing prior to remitting payment. The initial request should be in writing, and all copies of the correspondence should be kept for future reference.</p>



<h3 class="wp-block-heading"><a></a>Credit Repair</h3>



<p class="wp-block-paragraph">Another option when all else fails is to turn to a <a href="https://debtgameover.com/2021/09/are-credit-repair-companies-worth-it/" data-type="post" data-id="31">legitimate credit repair company</a>. They will work on your behalf to get the charge-off or other negative information removed from your credit report. That can be a time-consuming process, as the credit repair company has to investigate your financial situation and attempt to negotiate. They would not be doing anything that you would not be able to do for yourself. However, the fee associated with hiring a credit repair company may be worth the time and hassle they save you when disputing the charge-off.</p>



<h2 class="wp-block-heading"><a></a>Life After a Charge-Off</h2>



<p class="wp-block-paragraph">It’s not always possible to get a charge-off removed from a credit report. If that is the case, you will have to live with the charge-off for seven years. As the charge-off ages, its impact on your credit score lessens. The borrower will always be responsible for that debt and any future debt after that.&nbsp; Here are some things to do in the meantime that may help:</p>



<ul class="wp-block-list"><li>Build a positive payment history with all lenders going forward. Payment history accounts for about 35% of a credit score.</li><li>Limit credit inquiries so they won’t reflect against your account. Too many credit applications can cause a credit score to drop.</li><li>Pay down debt as much as you can to reduce your credit utilization ratio. You could even get a credit limit increase, with the intention to use it only for emergencies.</li><li>Continue to dispute any inaccuracies on your credit report to keep your report as accurate as possible going forward.</li></ul>
